The worker was not protected from falling by the use of a guard rail system, a safety net system or a personal fall arrest system.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: a) On or about April 9, 2014 at 365 Broadway, Saratoga NY 12866 a piece of debris with the nails pointing upward was left on the stairs from the basement to the first floor exposing employees to possibly stepping on the nails.
