29 CFR 1926.1101(k)(9)(i): The employer did not institute, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations:  a)  On or about April 9, 2014, and at times prior, the employer did not provide, at no cost to the employee, safety and health training to all employees who performed Class I through IV asbestos operations.  At least one employee was required to pay for an 8-hour AHERA asbestos refresher course.

29 CFR 1926.1101(m)(1)(ii): The employer did not ensure that all medical examinations and procedures were performed by or under the supervision of a licensed physician, and were provided at no cost to the employee and at a reasonable time and place:  a)  On or about April 9, 2014, and at times prior, the employer did not provide, at no cost to the employee, medical surveillance and a respirator medical evaluation to all employees who performed Class I through IV asbestos operations.  At least one employee was required to pay for his own medical surveillance exam and respirator medical evaluation.

29 CFR 1910.134(f)(2):  The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:    a)  On or about April 9, 2014, and at times prior, an employee was exposed to asbestos while he performed asbestos abatement work in a full face respirator that was not fit tested.
