29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    On or about April 9, 2014, at the above addressed jobsite, an employee was operating a rough terrain fork truck without training or certification, exposing the employee to the hazards associated with operating a rough terrain fork truck.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used:    On or about April 9, 2014, at the above addressed jobsite, employees were not provided with a safe means of access to a tubular welded frame scaffold, exposing employees to a fall of over thirteen (13) feet.     Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level:    On or about April 9, 2014, at the above addressed jobsite, employees performing masonry operations from a temporary elevated work platform, thirteen (13) feet six (6) inches above the ground, were exposed to injuries from falls due to the lack of guardrails.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:    On or about April 9, 2014, at the above addressed jobsite, employees lifted limestone blocks using lifting straps placed around a single fork of a Pettibone Traverse Lift Model T-8044 when this practice is not recommended and/or approved by the manufacturer. The employees were thereby exposed to struck by and/or fall hazards due to failure of lifting components.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
