29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) For the Hannoush shop at 23140 Fashion Dr., Estero, FL, as observed on or about 04/10/2014.  A written hazardous communication program for chemicals available and used in the workplace was not in place. Chemicals such as, but not limited to, Polychem Ultra CR and Stuller Tarnish Remover were used. These chemicals presented both potential respiratory hazards, skin contact irritation, and the potential for eye injuries upon contact.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace:    a) For the Hannoush store at 23140 Fashion Dr., Estero, FL 33928, as observed on or about 04/10/2014.  Employees used chemicals such as, but not limited to, Stuller Tarnish Remover and Ultra CR Concentrated Compound Remover. Safety data sheets were not available for all chemicals used in the workplace.

29 CFR 1910.157(g)(4): Employees who have been designated to use fire fighting equipment as a part of the emergency action plan were not provided training in the use of appropriate equipment upon initial assignment and at least annually thereafter:    a) For the Hannoush store at 23140 Fashion Dr., Estero, FL, as observed on or about 04/10/2014. Management employees were required to use fire extinguishers once other employees had left the building as part of evacuation procedures. Management employees had not received any fire extinguisher training since 1997.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.    a) For the Hannoush facility at 23140 Fashion Dr., Estero, FL, as observed on or about 04/10/2014.  An oxygen and an acetylene cylinder were stored right next to each other at the jeweler's work table. They were not chained in place to prevent them from falling over.
