At the Trader Joes construction site the employee elevated in the lift was not standing firmly on the floor of the basket, in that, he climbed out of the basket onto the parapet roof to continue working, on or about April 9, 2014.

29 CFR 1926.453(b)(2)(v):  A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  (a). At Building D of the Trader Joes construction site, employees elevated in the basket of an aerial lift were not using a body belt and lanyard or harness and lanyard to protect them from the 18-foot fall hazard, on or about April 9, 2014.
