OSHA ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall hazards while working at elevated heights during tree trimming operations. On or about April 10, 2014, at S. Spring Avenue and W. 49th Street in Lagrange, IL, an employee performing tree trimming operations was exposed to a fall hazard of approximately eleven feet. The employee had the required fall protection on, but failed to remain secured at all times while ascending the tree.

29 CFR 1910.67(c)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. a. On or about April 10, 2014 - at the above addressed jobsite, an employee performing tree trimming operations from a Vehicle-mounted Telescopic Boom Aerial Lift basket did not have a body belt and a lanyard secured to the basket, thereby exposing the employee to the hazards associated with a fall of more than ten (10) feet.
