Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees, in that employees were exposed to struck-by and fall hazards: On or about April 10, 2014 employees were riding in and working from the bucket of Caterpillar 430F backhoe/loader outside the protection of the cab. The loader/backhoe was left unattended by the operator with employees suspended in the bucket.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: On or about April 10, 2014, employees installing underground fuel storage tanks and lines used re-locatable power taps to charge and power equipment such as but not limited to rechargeable batteries, a RIGID 300-T2 pipe threading machine, a 10 amp reciprocating saw, a 10 amp grinder, and a 15 amp chop saw exposing employees to the hazards of electrical shock and fire hazards.
