29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) and (c): The employer does not protect employees from excavation cave-ins by an adequate protection system. This violation was observed on or about April 11, 2014, at the job site where employees were exposed to a crushed-by hazard while working in a 5 feet, 7 inches excavation without being protected from cave-ins by an adequate protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected cave-ins by an adequate protection system when working in excavations.
