29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 4/14/14, on the flat roof of a building under renovation at 5793 South Park Ave., Hamburg, NY: Two employees were exposed to a potential fall ranging from approx. 6 ft. to the lower level to approx. 13 ft. to the ground while doing a final cleaning (asbestos remediation) of the stones and grids. Both employees were wearing full body harnesses, but neither was tied off to an anchor point. No other fall protection system was utilized to protect the employees. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about 4/14/14, on the flat roof of a building under renovation at 5793 South Park Ave., Hamburg, NY: Employees were exposed to a fall of up to 6 ft. when a Michigan 8 ft. stepladder was used to access the upper roof from the lower roof. The siderails of the stepladder only extended 23 1/2 inches above the upper roof. NO ABATEMENT CERTIFICATION REQUIRED
