One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  On 4/14/2014, an employee from C.A.P.S. INC. was exposed to hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  In the maintenance area, the employee used a Chevalier Milling Machine; Model # FM-3VS.  The milling machine did not have a machine guard.

29 CFR 1910.215(b)(9):   Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, were not constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section were exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top exceeded one-fourth inch.   On 4/14/2014, an employee from C.A.P.S. INC. was exposed to struck-by hazards.   A pedestal grinder, no serial #, was located in the maintenance area and did not have tongue guards installed.  A Dewalt bench grinder, serial # 200348-YL0289, had tongue a tongue guard, but it was not adjusted to approximately one-half inch; the adjustment should never exceed one-fourth inch.
