29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls were not utilized:    (a) At Brookfield Manufacturing on or about May 9th of 2014 an employee was exposed to noise levels exceeding those listed in Table G-16.  The worker's exposure was found to be 135.2 % of dose with an average exposure of 91.9 dBA for 8 hours and 20 minutes of sampling time.  Engineering controls had not been implemented and the employee was not required to wear hearing protection 100 % of the time while being exposed to the noise.    (b) At Brookfield Manufacturing on or about May 9th of 2014 an employee was exposed to noise levels exceeding those listed in Table G-16.  The worker's exposure was found to be 151.6 % of dose with an average exposure of 92.8 dBA for 9 hours and 12 minutes of sampling time.  A peak exposure of 167.9 dBA was recorded for this same worker.  Engineering controls had not been implemented and the employee was not required to wear hearing protection 100 % of the time while being exposed to the noise.    (c) At Brookfield Manufacturing on or about May 9th of 2014 an employee was exposed to noise levels exceeding those listed in Table G-16.  The worker's exposure was found to be 129.5 % of dose wth an average exposure of 91.1 dBA for 8 hours and 56 minutes of sampling time.  Engineering controls had not been implemented and the employee was not required to wear hearing protection 100 % of the time while being exposed to the noise.    (d) At Brookfield Manufacturing on or about May 9th of 2014 an employee was exposed to noise levels exceeding those liste in Table G-16.  The worker's exposure was found to be 129.4 % of dose with an average exposure of 91.1 dBA for 8 hours and 52 minutes of sampling time.  Engineering controls had not been implemented and the employee was not required to wear hearing protection 100 % of the time while being exposed to the noise.       NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:    (a) At Brookfield Fabricating Corporation on or about April 15, 2014 employees welded in a closed shop without capture hoods for the welding fumes, and the employer had not assessed the workplace to determine if personal protective equipment such as respiratory protection should be used to protect the workers.    (b) At Brookfield Fabricating Corporation on or about April 15, 2014 employees worked around loud noise sources including noises from grinding operations and impact noises from hammering of steel on steel, and the employer had not assessed the workplace to determine if personal protective equipment such as ear plugs and/or ear muffs should be used.  Screening sampling found that impact noise reached levels of 123.8 dBA and average background noise for someone just walking through the plant averaged 89.6 dBA.    (c) At Brookfield Fabricating Corporation on or about April 15, 2014 employees welded in the open without using welding screens and an assessment to determine if welding screens should be used had not been done.    (d) At Brookfield Fabricating Corporation on or about April 15, 2014 employees conducted activiities that created fire and burn hazards, such as welding, but a determination had not been made for the selection of clothing in the work space.  Clothes made of nylon and other synthetic fabrics were allowed in the work space where welding and burning were done.       NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
