29 CFR 1926.501(b)(14): "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    a. On the second floor of area D where employees were working on the interior walls and ceiling, the window openings were not effectively guarded, thereby exposing employees to a 15 foot fall hazard.  b. On the second floor hallway between area B and D where employees were working on the interior walls, the window openings were not effectively guarded, thereby exposing employees to a 15 foot fall hazard.  c. On the second floor area B hallway adjacent to the gym where employees were working on the interior walls, the window opening to the gym was not effectively guarded, thereby exposing employees to a 15 foot fall hazard.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members shall be installed between the top edge of the guardrail system and the walking/working surface when there is no wall or parapet wall at least 21 inches (53 cm) high.  a. On the second floor center ELA between area C and E where employees were working, the wall opening did not have a midrail installed, thereby exposing employees to a 15 foot fall hazard.

29 CFR 1926.502(b)(1): Top edge height of top rails, or equivalent guardrail system members, shall be 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level. When conditions warrant, the height of the top edge may exceed the 45-inch height, provided the guardrail system meets all other criteria of this paragraph.  Note: When employees are using stilts, the top edge height of the top rail, or equivalent member, shall be increased an amount equal to the height of the stilts.     a. On the second floor center ELA between area C and E where employees were working, the cable used as the top guardrail was installed at 36 inches high, thereby exposing employees to a 15 foot fall hazard.    The Daimler Group was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.502(b)(1), which was contained in OSHA inspection number 98674, citation number 1, item number 1 and was affirmed as a final order on December 20, 2011 with respect to a workplace located at 4151 Bridgeway Avenue, Columbus, OH 43219.
