OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazard(s) of being crushed:       (a) At the worksite - An employee unloading stone slabs from a container used a damaged synthetic tie-down to stabilize the slabs. The tie-down failed and the slabs fell and struck the employee;  on or about 04/15/14.        One feasible means of abatement is to remove synthetic web tie downs from service if excessive abrasive wear and cuts cause doubt as to the strength of the tie down, as referenced in Recommended Standard Specification For Synthetic Web Tie Downs, WSTDAT-1, 2005, Section 4.7.  Care should also be taken to protect the synthetic web tie downs from wear, as outlined in Section 4.3.6, which states tie downs shall always be protected from corners, edges, protrusions and abrasive surfaces with edge protection that resists abrasion, cutting or crushing.  Being fully aware of the condition of the synthetic tie downs can be accomplished by designated personnel by conducting initial, frequent and periodic inspections as per Section 4.5 of the WSDAT-1.       NOTE:   IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $ 1,000.00 AS PER 29 CFR 1903.19.
