29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about April 16, 2014, employees were utilizing a portable metal extension ladder to access the rooftop working level that was not extended three feet above the roofs peak nor was it secured to prevent displacement.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about April 16, 2014, employees working from a residential rooftop performing tear-of operations at a height greater than six feet were doing so without fall protection. Above the Peak Construction LLC was previously cited for a violation of this or its equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 492718, Citation Number 1, Item Number 1, Issued on 7/11/2012, and was affirmed final order on 2/15/2013, with respect to a workplace located at 1961 Church Street, Beloit, WI 53511.
