29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure: a) Brandywine Oral Surgery: Employees, (Dental Assistants) while performing tasks such as sanitizing dental furniture and equipment, were occupationally exposed to blood. The employer did not develop an Exposure Control Plan to minimize or eliminate employee exposure to blood and other potentially infectious materials. This was observed on April 21, 2014.

29 CFR 1910.1030(g)(2)(ii)(A): The employer did not ensure that training was provided to employees with occupational exposure at the time of initial assignment to tasks where occupational exposure might take place: a) Brandywine Oral Surgery: Employees (Surgical Assistants) were exposed to bloodborne pathogens while assisting the dentist when performing oral surgeries. The dental assistants sanitized dental furniture and equipment as necessary. The employer did not provide bloodborne pathogens training to the dental assistants at the time of initial assignment. This was observed on April 4, 2014.

29 CFR 1910.1030(h)(1)(ii)(B): The employer did not establish and maintain an accurate record for each employee with occupational exposure which includes a copy of the employee's hepatitis B vaccinations and any medical records relative to the employee's ability to receive vaccination as required by paragraph (f)(2) of the OSHA Bloodborne Pathogens Standard: a) Brandywine Oral Surgery: Employees, (Dental Assistants) while decontaminating dental furniture and equipment were exposed to blood.The employer did not maintain a record that the employees had completed the Hepatitis B vaccination series recommended by the U.S. Public Health Service. This was observed on April 4, 2014.
