29 CFR 1926.152(i)(5)(v): "Foundations." Tanks shall rest on the ground or on foundations made of concrete, masonry, piling, or steel. Tank foundations shall be designed to minimize the possibility of uneven settling of the tank and to minimize corrosion in any part of the tank resting on the foundation. (a) On or about 04/11/14, at the Gardens at Town Center Senior Apartments, located on 3027 3057 Latta Road, in Greece, New York, a 150 gallon tank of diesel fuel was not located on a foundation that would minimize uneven settling of the tank. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.152(k)(1)(i): The dispensing area shall be located away from other structures so as to provide room for safe ingress and egress of craft to be fueled. Dispensing units shall in all cases be at least 20 feet (6.08 m) from any activity involving fixed sources of ignition. (a) On or about 04/11/14, at the Gardens at Town Center Senior Apartments, located on 3027 3057 Latta Road, in Greece, New York, a 150 gallon diesel tank used for dispensing fuel was located adjacent to an equipment trailer and where scrap construction materials were stored obstructing access to the dispensing station. NO ABATEMENT CERTIFICATION REQUIRED
