29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Second floor, new residential construction located at 3542 South Sherwood Road, Smyrna, GA 30082. Employees were exposed to falls while installing a plywood subfloor at heights of approximately 11-feet, 10-inches from the lower level without a fall protection system in place.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) First floor, new residential construction located at 3542 South Sherwood Road, Smyrna, GA 30082. Employees were exposed to fall hazards of approximately 10-feet, 6-inches when the ladder used was not extended at least 3 feet past the second floor walking/working surface. Employees used a Werner (Model FS206) 6 ft. step ladder with a top step height at 5-feet, 9-inches to access a working level height of 10-feet, 6-inches.

Employees were exposed to falls while using a Werner (Model-FS206) 6 ft. Stepladder in the closed position which exposed employees to falls of approximately 5-feet, 9-inches to the concrete surface below. The manufacturer states that you cannot climb a closed stepladder as it may slip out from under the user in the closed position.
