29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. (a) Roof, new townhome construction located on Lot #75 Vintage Circle, Smyrna, GA 30080. Employees were exposed to eye injuries while operating pneumatic Hitachi (Model NV45AB2) Coil Roofing Nail Guns without eye protection. Employees not provided with safety glasses were exposed to fasteners, and flying debris while operating a pneumatic tool at 100 PSI.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Roof, new townhome construction located on Lot #75 Vintage Circle, Smyrna, GA 30080. Employees were exposed to falls of approximately 19-feet, 11-inches to the lower level while engaged in residential roofing activities on a 6/12 pitched roof with no fall protection system in place.

29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators. a) Front side, new townhome construction located on Lot #75 Vintage Circle, Smyrna, GA 30080. Employer allowed employees to use the TranzSporter (Model LH200) Platform Hoist as a ladder to access the roof. Manufacturer's general safety instructions state that this hoist should never be used as a ladder by personnel because of the obstructed lower rungs of the hoist can cause a fall resulting in severe injuries.
