29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.     (a)  Highway 468 - On or about April 22, 2014 an employee was working inside a 7 foot deep trench with no ladder or other means of egress.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.     (a) Highway 468 - On or about April 22, 2014 an employee was working inside a 7 feet deep trench with spoil pile next to the excavation. The spoil pile was not 2 feet away from the edge of the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except:     (a)  Highway 468 - On or about April 22, 2014 employee was exposed to hazard trench wall cave-in from working in a trench without shoring or sloping.        Delta Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652 (a)(1), which was contained in OSHA inspection number 313635211, citation number 01, item number 004 and was affirmed as a final order on March 1, 2011, with respect to a workplace located at 1455 West Government Street Brandon, MS 39286

29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. The employer did not ensure his employees were wearing PPE.  (a)  Highway 468 - On or about April 22, 2014 an employee was observed operating a Case 580 Super M Plus Series 2 Excavator without wearing a seatbelt.
