29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a) H&M Machine and Tool, LLC located in Toledo, Ohio; on or about March 28, 2014, the employer failed to provide medical evaluations for those employees who were required to wear tight-fitting filtering face piece respirators (Gerson 3800 respirators and disposable N95 particulate respirator) during mixing and painting operations. Employees were exposed to hazardous particulates such as, but not limited to, crystalline silica, ethyl benzene, and xylene.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a) H&M Machine and Tool, LLC located in Toledo, Ohio; on or about March 28, 2014, the employer failed to establish and implement a written respiratory protection program to address identification and evaluation of respiratory hazards, medical evaluations, fit testing, proper use of respirators, maintenance and care of respirators, training and information, program evaluations, and record keeping. Employees were required to wear tight-fitting filtering face piece respirators while performing mixing and painting operations. Employees were exposed to hazardous particulates such as, but not limited to, crystalline silica, ethyl benzene, and xylene.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):    a) H&M Machine and Tool, LLC located in Toledo, Ohio; on or about March 28, 2014, the employer failed to ensure  that employees, who were required to wear tight-fitting half mask respirators, were fit tested to determine if the respirator seal was adequate. Employees were required to wear tight fitted respirators during mixing and painting operations. Employees were exposed to hazardous particulates such as, but not limited to,  crystalline silica, ethyl benzene, and xylene.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) H&M Machine and Tool, LLC located in Toledo, Ohio; on or about April 25, 2014, the employer failed to provide training and evaluations to ensure that employees, operating powered industrial vehicles, such as forklifts, were competent to safety complete the task. Employees were exposed to struck-by, caught-in-between, and tip over hazards.

Employees are exposed to respiratory hazards such as, but not limited to, welding fumes, aluminum oxide, calcium aluminate cement, aluminosilicates, silica (crystalline and cristobalite), ethyl benzene, and xylene.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  a) H&M Machine and Tool, LLC located in Toledo, Ohio; on or about April 25, 2014, the employer did not ensure that daily examinations of the powered industrial vehicles, such as forklifts, were conducted before being put into service. Employees were exposed to struck-by and caught-in-between hazards in a case a forklift had any mechanical defects such as, but not limited to, hydraulic leaks and faulty brakes.
