29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.     (a)Bennetts Roofing @ 43616 CR-13, Haxtun, CO80731: On and before April 4th, 2014, the employer did not ensure a competent person conducted frequent and regular inspections of the job-site, materials, and equipment. On April 4th, 2014, employee was permitted to remove existing roofing materials from a barn (Gambrel) style roof without fall protection. As a result, an employee was seriously injured after falling approximately 16 feet.       Abatement Note: OSHA defines a competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   (a)Bennetts Roofing @ 34616 CR-13, Haxtun, CO 80731: On and before April 10th, 2014, the employer did not ensure the use of appropriate fall protection while an employee removed existing layers of shingles from a barn (Gambrel) style roof. As a result, on April 4th, 2014, an employee was hospitalized with serious injuries after falling approximately 16 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   (a)Bennetts Roofing @ 34616 CR-13, Haxtun, CO 80731: On and before April 4, 2014, the employer did not ensure an employee working on a barn (Gambrel) style roof was trained to recognize the hazards associated with falling and appropriate installation and use of fall protection systems to minimize falls from elevations.  As a result, the exposed employee received serious injuries after falling approximately 16 feet.       Abatement Note:  The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:      (1)  The nature of fall hazards in the work area;  (2)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  (3)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  (4)  The role of each employee in the safety monitoring system when this system is used;  (5)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  (6)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection;   (7)  The role of employees in fall protection plans; and,  (8)  The standards contained in this subpart.
