OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard or caught in hazard from steel I-beams toppling over while in the process of setting them upright.  On or about 25 April 2014, and at times prior thereto, three employees were both moving and setting upright steel I-beams at the construction site in order to prepare them to be lifted into place for the steel erection of a building. In the process of performing the task, two employees would walk between upright beams into the middle to allow the hooks and sling of the rigging to be cabled up by the crane, and used for the next beam next to that location a few yards away. While doing so, the eyelet, or hook, caught the lip or corner of an I-beam, causing it to topple over and crush the ankles of an employee.

29 CFR 1926.251(a)(2)(i): The employer failed to ensure rigging equipment had permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load.   On or about 25 April 2014, and at times prior thereto, the employer allowed a wire rope sling to be utilized in standing steel I-beams upright while on the ground, which did not have permanently affixed and legible identification markings to indicate the recommended safe working load, exposing the employees using the rigging to the hazard of being struck by either the beam from a sling failure or by the sling whiplashing due to failure.

29 CFR 1926.251(a)(2)(iii): The employer failed to ensure that rigging without affixed, legible identification markings, required by paragraph (a)(2)(i) of this section was not used.  On or about 25 April 2014, and at times prior thereto, the employer allowed a wire rope sling to be utilized in standing steel I-beams upright while on the ground which did not have permanently affixed and legible identification markings to indicate the recommended safe working load, exposing the employees using the rigging to the hazard of being struck by either the beam from a sling failure or by the sling whiplashing due to failure.
