29 CFR 1926.21(b)(2):   The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  -The employer did not have an adequate safety and health program in place for employees to recognize and avoid safety and health hazards in that on April 27, 2014 there were three excavations without adequate side wall protection, with employees exposed to cave in hazards in all three excavations.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.652(a)(1):   Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):  -On April 27, 2014:  a.) Excavation #1 was 6'-5" deep, 23'-6" in length and 7'-5" in width with no side wall protection as two employees were in the bottom installing a new 16' ductile iron water main.  b.) Excavation #2 was 6' deep, approximately 20' in length and 4'8" in width with no side wall protection as two employees were in the bottom installing a new 12" ductile iron water main.  c.) Excavation #3 was 5'-6" deep, approximately 14' in length and 5'-6" in width with no side wall protection as three employees were in the bottom installing new 12" ductile iron water main.
