OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crush hazards. Site: 40 West 22nd Street New York, NY On or about 4/24/14 a) Employer replaced the elevator hoist doors without having an engineer or manufacturer approval. The new doors switch did not have safety interlocks on the doors. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THIS HAZARDS IS: 1. Comply with the ASME A17.3-2011 (Safety Code for Existing Elevators and Escalators) Section 1.5, page 17. Alterations, Maintenance, Inspections and Tests. Existing installations shall conform to the following requirements of ASME A17.1-2004. (b) Requirements 8.6, Maintenance, Repair and Replacement; and 8.7, Alterations. 2. ASME A17.1-2007/Revision of ASME A17.1-2004 (Safety Code for Elevators and Escalators. 2.12.2.1 General. Each entrance at a landing to an elevator used for passengers or freight and not conforming to 2.12.3.1 shall be equipped with one or more interlocks meeting the design requirements of 2.112.2.4 8.6.12.4 Repairs and Replacement, 8.6.12.4.1 Replacement Parts and Quality of Work and 8.6.12.4.1.1 Replacement Parts and Components. Unless otherwise required in 8.6.12.5, any repair and replacement of damage or worn parts or components shall be with parts of material and strength equivalent to or better than the original manufacturer's or design. Any change in the design of components other than those specified in 8..12.5 or 8.7, that might affect the safe operation of the equipment shall be certified for use by a professional engineer. A copy of the certification shall be retained by the contractor and recorded in the log book.
