29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:    a) On or about 4/25/14, in the former Office Depot Store Construction site, Sheridan Plaza, 2309 Eggert Rd., Tonawanda, NY: An unsecured metal 4-receptacle outlet box was laying on the floor. A flexible cord spliced into wires hanging out of a junction box on the wall and running along the floor, was connected to the metal 4-receptacle outlet box, supplying 120 volt-ac power to the receptacles in the box. This set-up was installed by the Electrical Contractor to supply electrical power for use by contractors on the site. Article 370-13 of the National Electric Code requires the metal 4-receptacle outlet box to be rigidly and securely fastened in place.    NO ABATEMENT CERTIFICATION REQUIRED

An employee plugged in a Milwaukee portable bandsaw into one of the receptacles, used the bandsaw to cut conduit, and then unplugged the saw.        NO ABATEMENT CERTIFICATION REQUIRED
