29 CFR 1926.1101(f)(2)(i):  The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation:        a)  On or about April 23, 2014, and at times prior, employees were exposed to unknown quantities of airborne asbestos fibers while conducting maintenance and housekeeping activities that disturbed asbestos containing materials (ACM) or presumed asbestos containing materials (PACM) such as drywall and ceiling texturing because the employer failed to perform an initial exposure assessment at or before the commencement of these  activities.

29 CFR 1926.1101(g)(9): The employer did not follow the work practices and engineering controls for Class III asbestos work specified in 29 CFR 1926.1101(g)(9)(i) through (g)(9)(v), to minimize the exposure to employees:     a)  On or about April 23, 2014, and at times prior, employees were exposed to unknown quantities of airborne asbestos fibers while conducting maintenance and housekeeping activities that disturbed asbestos containing materials (ACM) or presumed asbestos containing materials (PACM) such as drywall and ceiling texturing because the employer did not ensure that controls such as isolation/enclosures, ventilation, and wet methods were utilized.

29 CFR 1926.1101(k)(9)(i):  The employer did not institute a training program for all employees who are likely to be exposed in excess of a PEL and for all employees who perform Class I through Class IV asbestos operations, and did not ensure their participation in the program:    a)  On or about April 23, 2014, and at times prior, employees were exposed to asbestos because they were not provided with adequate training for Class III and Class IV asbestos operations.  Several employees regularly conducted Class III asbestos activities, cutting through asbestos containing materials (ACM) or potentially asbestos containing materials (PACM) such as surfacing materials for drywall and ceilings in order to perform maintenance work.  In addition, both maintenance and housekeeping staff conducted Class IV asbestos activities on a daily basis.

29 CFR 1926.1101(k)(2)(i): Before work subject to this standard was begun, building and facility owners did not  determine the presence, location, and quantity of ACM and/or PACM at the work site pursuant to paragraph (k)(1) of this section:    a)  On or about April 23, 2014, and at times prior, employees were exposed to asbestos fibers because the employer failed to determine the presence, location and quantity of asbestos in wall and ceiling texturing that was occasionally disturbed by maintenance and housekeeping employees and failed to provide such information to the employees working in the building.
