29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.    a.  On or about April 28, 2014 - at the above addressed jobsite, the employee who was required to operate the PETTIBONE T8044 Rough Terrain Forklift was not evaluated on performance at least once every three years, thereby exposing employees to struck by hazards.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.    a.  On or about April 28, 2014 - at the above addressed jobsite, an employee performing masonry operations from a tubular welded frame scaffold outrigger plank, more than twenty (20) feet above the ground, was exposed to injuries from falls due to lack of side rails.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a.  On or about April 28, 2014 - at the above addressed jobsite, employees performing masonry operations on the third floor deck, more than twenty (20) feet above the ground, were not protected from falls, thereby exposing the employees to fall hazards.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  a.  On or about April 18, 2014- at the above addressed jobsite, the employer failed to provide a written certification record of training for each employee exposed to fall hazards.
