29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: a) On or about 4/25/14, in the former Office Depot Store Construction site, Sheridan Plaza, 2309 Eggert Rd., Tonawanda, NY: An unsecured metal 4-receptacle outlet box was laying on the floor. An employee plugged a yellow extension cord into a receptacle on the box. A chop saw was plugged into the female end of a second extension cord in the series and was used to cut metal studs. Article 370-13 of the National Electric Code requires the metal 4- receptacle outlet box to be rigidly and securely fastened in place. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. a) On or about 4/25/14, in the former Office Depot Store Construction site, Sheridan Plaza, 2309 Eggert Rd., Tonawanda, NY: A chop saw was used to cut metal studs, and was connected to 120 volt-ac power via a series of extension cords, the first of which was plugged into a receptacle on a 4-receptacle outlet box. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED
