Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about April 25, 2014, at the Place St. Charles Building, the employer failed to provide a place of employment free from the recognized hazard of falling from a swing stage scaffold when the power climber hoist assembly attached to the scaffold in order to raise it to a designated level where window cleaning would be performed malfunctioned, causing one side of the scaffold to fall. Feasible Means of Abatement: The hazard can feasibly be abated by steps including but not limited to ensuring that operator(s) of the Power Climber hoist assembly understand and follow the instructions included in the manufacturers operating manual before operating the hoist, as specified by the Manufacturers Operating Instructions, and are proficient in safe working procedures and proper use of the equipment, as specified by ANSI/IWCA I-14.1-2001 Window Cleaning Safety.
