29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) L & S Tool & Machine, 710 Willow Springs Lane, York, Pennsylvania - Employees did servicing and maintenance work on a variety of machinery and equipment, including, but not limited to, the various CNC turning and milling machinery, such as, the Doosan Lynx 220L CNC lathe and the Doosan HP5500 CNC horizontal milling machine, and the employer has not developed and implemented machine specific energy control procedures, exposing employees to caught-in, struck-by and other hazards resulting from unexpected energization, on or about April 30, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): (a) L & S Tool & Machine, 710 Willow Springs Lane, York, Pennsylvania - The employer's energy control procedures did not require employees to lockout/tagout, and employees did not lockout/tagout, the various CNC turning and milling machinery, including, but not limited to, the Doosan Lynx 220L CNC lathe and the Doosan HP5500 CNC horizontal milling machine, at any time when employees did set up on these machine, exposing employees to caught-in, struck-by and other hazards resulting from unexpected energization, on or about April 30, 2014. 29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (a) L & S Tool & Machine, LLC, 710 Willow Springs Lane, York, Pennsylvania - Employees operated CNC turning and milling machines that used metal working fluids, such as Castrol Hysol MB50, which classifies as a hazardous chemical, and the employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively, on or about April 30, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
