29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms were not kept clean and orderly and in a sanitary condition:    a) Worksite, on or about June 6, 2014, K-Plant - The floor, I-beams, platforms and stairs were coated with dust from K-Plant operations such a mixing and crushing materials.   Empty boxes, bins, cans, and plastics were located throughout the work area and on stairs.    The poor housekeeping presented slip, trip, and fall hazards in addition to inhalation concerns from dusty areas.

29 CFR 1910.134(c)(1): In any workplace where respirators were necessary to protect the health of the employee or whenever respirators are required by the employer, the written respiratory protection program was not updated as necessary to reflect those changes in workplace conditions that affect respirator use:       a) Facility, on or about April 30, 2014 - The respiratory protection program was not updated to address specific respiratory hazards during non-routine tasks that required tight-fitting organic respirator usage.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace:     a) Facility, on or about April 30, 2014 - Mechanic employees, who were required to wear tight-fitting respirators while addressing maintenance duties in the TI Building and changing the Hot Box Resin totes, were not provided medical evaluations prior to fit test.

29 CFR 1910.1048(i)(3): When there was a possibility that an employee's eyes may be splashed with solutions containing 0.1 percent or greater formaldehyde, the employer did not provide acceptable eyewash facilities within the immediate work area for emergency use:  a) K-Plant, between #6 Press and #2 Mixer, on or about June 6, 2014 - Splashes of phenolic resin, which contained 66% of phenol formaldehyde resin, occurred during the handling of the 250-gallon totes.  There are no eyewash stations in the immediate area.   b) T-Plant, Warm Room, on or about June 6, 2014 - Splashes of phenolic resin, which contained 66% of phenol formaldehyde resin, occurred during the handling of the 250-gallon totes.  There are no eyewash stations in the immediate area.

29 CFR 1910.1200(h)(2)(iii): The employer did not provide employees with effective information on the location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets required by this section:  a) Facility, on or about June 6, 2014 - Employees were unaware of where the material safety data sheets were located for hazardous chemicals used to manufacture resin and non-resin brick.  Employees were exposed to hazardous chemicals such as but not limited to: liquid phenol formaldehyde resin; the chemical products used in resin brick manufacturing such as but not limited to: zirox, iron oxide, powder phenolic resin (Durite), stearic acid, fused magnesia, dolomite fines, deadburned magnesite, and deadburnt dolomite;  and oil mist.
