29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent: (a) Reist Popcorn - The employer did not develop and implement a hearing conservation program for employee(s) whose noise exposure exceeded an 8-hour time weighted average of 85 dBA. A production employee's noise exposure was 88.0dBA while working in the popcorn processing area, on or about June 6, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Reist Popcorn Co. - The employer did not provide a production employee with a medical evaluation to ensure that the employee was medically able to wear a 3M N95 respirator while cleaning dust/chaffs in the plant on or about May 1, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.24(h): Standard railings were not provided on the open sides of all exposed stairways and stair platforms. Handrails were not provided on at least one side of closed stairways preferably on the right side descending: (a) Production Area - The stairway going from the first floor to the satake room contained 18 risers. The stairway did not have a mid-rail, on or about May 1, 2014. (b) Garage - The stairway going from the lower level to the mezzanine did not have a mid-rail. The stairway contained 14 risers, on or about May 1, 2014.
