29 CFR 1910.178(c)(2)(vi)(a): Approved power operated industrial trucks designated as EX were not used in atmospheres in which combustible dust was or may be in suspension continuously, intermittently, or periodically under normal operating conditions, in quantities sufficient to produce explosive or ignitable mixtures, or where mechanical failure or abnormal operations of machinery or equipment might cause such mixtures to be produced:       The employer does not ensure only approved power operated industrial trucks designated as EX are used in atmospheres in which combustible dust is present. This violation was occurred on April 30, 2014 throughout the facility, where employees operated powered industrial truck in areas with combustible dust.  Employees used a Komatsu 585452A-LP in areas that contained combustible dust.

29 CFR 1910.307(c)(2)(i):  Equipment was not approved for the class of location, and for the ignitable or combustible properties of the specific gas, vapor, dust, or fiber that was present:     This violation occurred on April 30, 2014 at a work place located at 503 Industrial Blvd. Terrell, TX 75160; on the production area where the employer did not ensure that equipment is approved for the class of location, and for the ignitable or combustible properties of the saw dust:      a) Employees operated a Morgan Gang Saw and other power tools in the production areas which dispensed saw dust (Class II combustible dust). The operation of the Morgan Gang Saw and other power tools created the release of the saw dust intermittently throughout the day. General purpose wiring, breaker panel boxes, disconnect switches, and receptacles were not dust-tight ignition proof and approved for Class II  locations.     b)Employees operated a Pencil Point machine and other power tools in the secondary production areas which dispensed saw dust (Class II combustible dust). The operation of the pencil point machine and other power tools created the release of the saw dust intermittently throughout the day. General purpose wiring, breaker panel boxes, disconnect switches, and receptacles were not dust-tight ignition proof and approved for Class II  locations.
