OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to caught in hazards:   a) On or about May 2, 2014 and at times prior, an employee's right had was caught in an energized auger while performing maintenance on a Carlson CP-90 paver machine.    Abatement Note:  Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the safety instruction and requirement set forth in accordance with the manufacturer's operator instruction manual, as follows:  1. Allow only trained personnel to operate this machine. Proper training of all personnel that will be on or around the machine is essential in the prevention of accidents. Training must include an understanding of all safety warnings and decals and recommended operation and maintenance procedures.  2. The operator must always be sure both left and right hand auger controls are "off", not "auto" or "manual" before leaving the operators seat.  3. Do not attempt to get material from the hopper or auger.  4. Remove master key and attach a do not operate tag to the starter switch when performing maintenance or repairs.  5. Always shut off the engine when working on the conveyor, auger or otherwise servicing the machine.
