29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    Near the center of the bridge:  The seat belt was not worn while operating and moving a Komatsu WB156 backhoe to dig a trench for storm water pipes and drains. The operator was exposed to the hazard of being struck by the backhoe and caught between the backhoe and other surfaces.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    Near the center of the bridge:  A one foot high spoil pile was located immediately adjacent to the 32 foot long south face of the trench. The trench was about five feet deep, including the spoil pile, by about six feet wide. Employees, in the trench installing storm water pipe and drains, were exposed to the hazard of being struck by large rocks and soil in the spoil pile.
