29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:      MBTA Government Station Street Demolition and Excavation:  The employer failed to provide the employee working in an unprotected excavation/trench that was eight to nine feet in depth with proper egress in event of a cave-in.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    MBTA Government Station Street Demolition and Excavation:  The employee was exposed to additional cave-in hazards, and from being struck by soil, brick, pipe and other excavated materials while operating a gasoline powered chop saw in an eight to nine foot deep excavation/trench where the excavated spoil pile was located directly at the edge of the excavation/trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).       MBTA Government Station Street Demolition and Excavation:   The employee was exposed to cave-in hazards while operating a gasoline powered chop saw in an eight to nine foot deep excavation/trench with straight cut earthen walls without an adequate protective system.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    MBTA Government Station Street Demolition and Excavation:  The employer's Excavation/Trench Competent person failed to inspect the eight to nine foot deep excavation/trench to determine protective measures necessary to protect employees and/or prevent cave-in, location of the spoil pile directly at the trench edge, proper means of egress from trench excavations and allowing an employee to enter the unprotected excavation/trench and operate a gasoline powered chop saw.

29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:    MBTA Government Station Cambridge Street Demolition and Excavation:  The employee was exposed to eye hazards of flying particles of copper, plastic, soil, rocks, debris, and excessive noise while operating a STIHL TS420 Chop Saw (cut-off machine) used to cut abandoned copper cables without, eye, face and hearing protection.
