29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) Paschal, Bihn & Sons Excavating, LLC on or about May 2, 2014, at the site located near the intersection of Fulton & 4th Streets in Port Clinton, OH: The employer failed to ensure a safe means of egress such as a ladder was placed in the 5 ft. deep trench while an employee was prepping the base for a water pipe install.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours. a) Paschal, Bihn & Sons Excavating, LLC on or about May 5, 2014, at the site located near the corner of Fulton & 4th Streets, Port Clinton, OH : The employer did not provide the representative of the Dept. of Labor, OSHA 300 logs for the year 2014 upon request in a timely manner. Requests were made on three different days to the company representative for the records kept under Part 1904.
