OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: At 33340 Cadiz Piedmont Road in Piedmont, Ohio, employees were working in the roadway were not wearing high visibility apparel while operating the chipper and clearing up the tree limbs. Employees were exposed to roadway moving traffic.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a. An employee was operating a chainsaw on the ground without leg protection such as chaps or other cut resistant material. The employee was exposed to an amputation hazard.
