29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) On or about April 10, 2014, an employee was exposed to a fall hazard, greater than 10 feet to the dirt ground below, while working from a scaffold, landing a bucket of mortar, without a midrail guardrail installed on the end rail of the scaffolding. b) On or about April 10, 2014, an employee was exposed to a fall hazard, greater than 10 feet, while working from a scaffold, landing a bucket of mortar, without a midrail guardrail installed on material landing access gate.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about April 10, 2014, an employee was exposed to a fall hazard, greater than 6 feet to the dirt ground below, while working from the top of the building under construction (top of the second floor), performing masonry work on the elevator shaft, standing at the perimeter of the floor.
