29 CFR 1910.178(o)(2): Load(s) were being handled which exceeded the rated capacity of the industrial truck(s): The employer does not ensure that all loads being handled by forklifts weigh less than the forklifts rated capacity. This violation occurred on or about May 02, 2014, outside of the storage warehouse where employees were exposed to struck-by and crushed-by hazards while trying to lift a metal part being delivered without ensuring its weight was within the forklifts rated capacity. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all industrial trucks are used as intended in accordance with 29 CFR 1910.178.

29 CFR 1910.178(q)(6): Industrial trucks were altered by the addition of extra parts not provided by the manufacturer. Additional counterweighting of fork trucks was not approved by the truck manufacturer: The employer makes alterations to forklifts that affect its capacity and safe operation without the manufacturer's approval. This violation occurred on or about May 02, 2014, outside of the storage warehouse where employees were exposed to struck-by hazards while using a forklift that was fitted with additional counterweighting without receiving approval from the manufacturer for the additional weight. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all modifications/alterations made to powered industrial trucks that can affect the capacity and safe operation are approved in writing by the manufacture.
