29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: Employees, working on top of the fuel tank, located in the basement of 270 W 17th St New York, NY 10016; used the tank as a platform to pump oil out of the tank; the tank was not guarded by railings, the top of the tank is approximately 12 feet above the adjacent floor. The condition was noted on or above May 6, 2014. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
