29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about May 7, 2014, employees were exposed to chemical hazards, including isocyanate compounds and methyl ethyl ketone, when mixing paints and coatings and cleaning supplies. The employer had not developed a written Hazard Communication program. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent: Magnolia Advanced Materials - on or about May 7, 2014, an employee experienced an injury resulting from dermal contact with methyl ethyl ketone (MEK), and was placed on work restriction for ten days. The employer did not record the injury on the OSHA 300 Log of Work-Related Injuries and Illnesses, or equivalent form. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The employer had not developed a written Respiratory Protection program. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
