29 CFR 1910.134(c)(2): The employer did not develop and implement a respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:  Employees were exposed to potential adverse health conditions when the employer provided and encouraged workers to wear filtering facepiece respirators and permitted the voluntary use of elastomeric half-facepiece respirators during sewer manhole restoration.  The employer failed to establish and implement elements of a written respiratory protection program to ensure the safe, voluntary usage of respirators while mixing and applying the QM-1s Restore:    - Conduct a medical evaluation to determine the employee's ability to use a respirator; - Train employees on the proper use and effective maintenance of elastomeric respirators; - Ensure that employees did not have facial hair while wearing tight-fitting respirator facepieces; - Provide employees voluntarily wearing filtering face piece and elastomeric respirators with copies of Appendix D of 29 CFR 1910.134.

29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required:    Location:  9848 Madison Avenue, St. Louis, MO  63119    On or about March 7, 2014, the employer did not ensure workers were adequately trained to identify and recognize hazards associated with entering confined spaces.  Workers were exposed to a potentially hazardous atmosphere when assigned the task of applying QM-1s Restore liner in sewer manholes.  The employer failed to provide adequate training to the employees in the following instances:       (1)  Employees were not adequately trained to recognize and avoid potential atmospheric hazards associated with permit-required confined spaces;      (2)  Employees were not provided instruction on how to properly operate sampling equipment to conduct atmospheric testing;       (3)  An employee was not provided instruction on how to complete the employer's confined space permit.
