29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) For employees working at 12611 South Cleveland Avenue in Fort Myers, as observed on or about 6 May, 2014. Employees were installing stucco while standing on a 5:12 pitch roof of the building. Employees were working at an approximate height of 12 feet above the ground and the employees were not protected from falling.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation: a) For employees working at 12611 South Cleveland Avenue in Fort Myers, as observed on or about 6 May, 2014. Employees were installing stucco on the upper working surface of the building and stepping onto a supported scaffold that did not have base plates installed exposing employees approximately 12 feet above the ground to scaffolding collapse.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person. a) For employees working at 12611 South Cleveland Avenue in Fort Myers, as observed on or about 6 May, 2014. Employees installed a tubular frame scaffolding to hoist material to the upper working surface that was not erected or inspected by a competent person qualified in scaffolding erection. Tubular frame scaffolding was missing base plates and did not have fall protection installed on all sides to exposing employees to a fall hazard of approximately 12 feet.
