29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: a) For employees working at 138 Standart Avenue in Auburn New York, on or about April 1, 2014. An employee working on the third floor of the building fell to the ground after the guardrail system that was installed to protect employees failed. The guardrail system as installed was not capable of withstanding without failure a force of at least 200 pounds.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: a) For employees working at 138 Standart Avenue in Auburn New York, on or about April 1, 2014. Employees were working on the third floor balcony receiving material that was being handed up from the ground below. The balcony area that the employee was standing and walking across was not kept clear of construction debris.
