29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. On or about May 8, 2014 and at times prior thereto, on the third floor, northeast side, the employer did not ensure that employees engaged in custodial activities such as dusting and cleaning were protected from falls of greater than 4 feet. Instance a: Employees engaged in dusting and cleaning of the State Dinner exhibit were exposed to unprotected falls of greater than 20 feet to the lower level below. Instance b: Employees engaged in dusting and cleaning of the Chihuly Tree exhibit were exposed to unprotected falls of greater than 20 feet to the lower level below.
