29 CFR 1926.300(b)(4)(ii): The point of operation of machine(s) whose operation exposed an employee to injury was not guarded: The employer does not guard all the rotating parts of machines to protect the operator and other employees in the construction area. This violation was observed on or about May 11, 2014, on the construction site where an employee was exposed to struck-by and caught-by hazards when operating a Makita brand circular saw without a guard. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all machines that have exposed rotating parts are guarded.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used: The employer does not ensure all worn or frayed electrical cords or cables are not used. This violation was observed on or about May 12, 2014, on the west side of the construction site, where an employee was exposed to an electrical hazard while using a Makita brand circular saw with a worn electrical cord.
