29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: a) On or about 5/12/14 at the 7-Eleven Store located 3550 Genesee Street, Cheektowaga, New York; employees working on the ground during the renovation of the canopy were not wearing protective helmets while employees were working above dismantling the roof structure. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 5/12/14 at the 7-Eleven Store located 3550 Genesee Street, Cheektowaga, New York; employees were dismantling the roof structure of a service station canopy that was 14'-7" high. The was no fall protection in use. NO ABATEMENT CERTIFICATION REQUIRED
