29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:    (a) First floor, new residential construction located on Lot#35 Wynnward Way, Sharpsburg, GA 30277: Employee was exposed to amputation hazards while cutting 2x8 roof rafters with a Makita (Model-5007F) 7-1/4-inch Circular Saw with the guard propped open with a wooden shim.

29 CFR 1926.451(b)(2): Scaffold platforms and walkways were not at least 18 inches wide:    (a) First floor, new residential construction located on Lot #35 Wynnward Way, Sharpsburg, GA 30277: Employees were exposed to fall hazards of approximately 11-feet, 6-inches to the subfloor while setting a ridge beam from a makeshift 2x8 scaffold plank which measured approximately 7-inches wide x 10-feet long. The scaffold platform used was not at least 18-inches wide.

(a) First floor, new residential construction located on Lot #35 Wynnward Way, Sharpsburg, GA 30277: Employees were exposed to fall hazards of approximately 11-feet, 6-inches to the subfloor while installing a ridge beam from a makeshift scaffold platform in which a fall protection system was not provided.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:    (a) First floor stairway, new residential construction located on Lot #35 Wynnward Way, Sharpsburg, GA 30277: Employees used a stairway with no stair rail installed to access the second floor exposing employees to falls to the lower level. The stairway from the first floor to the top of the 7th tread (8 risers high) was not provided with a stair rail to prevent falls of up to 5-feet, 2-inches to the lower level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a)  First floor, new residential construction located on Lot #35 Wynnward Way, Sharpsburg, GA 30277: Employee was exposed to falls while working at heights of approximately 10-feet, 7-inches on the first floor cutting roof rafters with no guard rails on the back side of the home to prevent falls to the lower level.     (b) Second floor, new residential construction located on Lot #35 Wynnward Way, Sharpsburg, GA 30277: Employee was exposed to falls of approximately 16-feet, 6-inches to the lower level while engaged in framing activities without a fall protection system in place.    Sandoval's Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 891197, citation number 1, item number 1 and was affirmed as a final order on 05/22/2013, with respect to a workplace located at 155 Nesmith Court, Fayetteville, GA 30215.
