Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a.     On the 3rd level of Zone 2, there was a unguarded wall opening which measured 40 1/2 by 40 1/2 thereby exposing employees to a 20 foot fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.    a.      On the second level at the rear of the building, an employee was observed climbing through the guardrail to an unguarded platform to unload 2 x 4 boards without fall protection.       The Duran Lopez Construction LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 315496703 and 808781, citation number 1, item number 2 and was affirmed as a final order on 10-8-2011 and 4-8-2013, with respect to a workplace located at 6800-6900 Palmera Dr. Mason, Ohio 45040 and Thompson Road and Chestnut Drive , Columbus, Ohio.
